Kate Symms

Family Law Barrister

I have been practising in the field of ancillary relief and related financial matters for more than 20 years. I have experience of dealing with high value cases and applications involving pension sharing, school fees claims, inheritance claims, division of company assets, assets overseas, complex family and business trusts and farming interests.

I have also dealt with a number of financial claims relating to unmarried couples and child maintenance claims, both in England and being enforced from overseas. I have been involved in a number of cases involving the Trusts of Land and Appointment of Trustees Act 1996 (“TOLATA”).

My recent cases include:

G v G: a case with substantial assets where I negotiated a successful settlement for my client which resulted in her getting a 50% share of her husband's £1m plus pension whilst retaining full ownership of the former matrimonial home.

M v M: a very complex case where my client's father was a very wealthy businessman who was the owner of a nationwide business with more than 350 stores and 13,000 employees. He had set up a substantial trust for the family whose beneficiaries included my client’s wife and children. I successfully avoided any claim on the trust and then negotiated a very favourable settlement.

W v W: I acted for a father whose own father had a number of businesses. There were claims in relation to the business and related property which I defeated notwithstanding the apparent conveyance of them into my client's  name

S v S: I resisted an appeal against a decision at first instance relating to 6 Spanish properties and property and businesses in England. The case involved disclosure issues in relation to hidden assets and substantial allegations of dishonesty against my client.
